THE PIVOT PLAYBOOK LIVE

Please read these Terms of Use for THE PIVOT PLAYBOOK LIVE (DFW) carefully and in their entirety before purchasing or participating in the Workshop. The Workshop and its content are owned by Skye Edmonds and Work of Heart Photography.

Definitions

“Company,” “We,” “I,” “Our,” or “Us” refers to Skye Edmonds and Work of Heart Photography.

“Workshop” refers to THE PIVOT PLAYBOOK LIVE (DFW), including all scheduled shoots, activities, materials, and associated experiences.

“Participation,” “Participating,” “Using,” or “Use” refers to attending, engaging in, or otherwise participating in any part of the Retreat.

“You” or “Your” refers to the purchaser and participant of the Retreat.

Consent

By purchasing and/or participating in the Workshop, you voluntarily agree to these Terms of Use and acknowledge that you have read, understood, and agree to abide by them.

You have read, understood and agree to the following:

Refund Policy

All Workshop fees are non-refundable. No exceptions will be made.

Due to the nature of event planning and associated costs, your registration secures your seat and the resources allocated for your participation.

Attendee Transfer

If you are unable to attend, you may transfer your Workshop seat to another attendee. You are responsible for finding the new attendee, arranging the transfer and securing payment from the new attendee. All transfers must be approved in advance by Work of Heart Photography.

Event Cancellation / Rescheduling

If the Company cancels the event for any reason, attendees will receive a full refund of all registration fees within seven (7) to fourteen (14) business days.

If the event is rescheduled, registrations will automatically transfer to the new date and/or location. Registration fees remain non-refundable. Attendees unable to attend the rescheduled event may transfer or sell their registration in accordance with these Terms.

Transfer to Future Events

Registration is valid only for the event date purchased. Registrations may not be transferred to future events, deferred, or applied as credit toward future offerings. If an attendee is unable to attend, they may transfer or sell their seat in accordance with these Terms of Use.

Intellectual Property

All educational materials, frameworks, worksheets, presentations, prompts, AI tools, and intellectual property presented during The Pivot Playbook LIVE remain the sole property of Skye Edmonds and Work of Heart Photography. Attendees may use the materials to build their own workshop or retreat but may not reproduce, teach, resell, license, distribute, or create derivative educational programs based upon the Company's proprietary frameworks.

Printed Workbook

Attendees will receive the printed Pivot Playbook workbook only by attending the live event. If an attendee does not attend for any reason, a digital version will be provided instead. Printed workbooks will not be shipped after the event.

Recording Policy

No audio recording, video recording, livestreaming, screen recording, or photography of teaching presentations, slides, workbook pages, demonstrations, or instructional content is permitted once instruction begins unless expressly authorized by the Company.

Event Communications

Attendees are responsible for monitoring the email address used during registration and the designated event community for all event announcements, updates, schedules, and instructions. The Company is not responsible for missed communications due to failure to review event updates.

Weather

The Workshop will proceed rain or shine.

Force Majeure (Acts of God)

Work of Heart Photography is not responsible for circumstances outside of its control, including but not limited to:

Acts of God, natural disasters, terrorism, civil unrest, pandemic, epidemic, governmental action, fire, flood, power failure, or other unforeseen disruptions.

In the event such circumstances affect the Workshop, Work of Heart Photography may determine alternative solutions, including rescheduling or adjustments to the event schedule. However, the Company shall not be responsible for any personal loss, damage, travel costs, or other expenses incurred by attendees.



Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, epidemic, pandemic, accident, work stoppage, chemical spill, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.

Travel Responsibility

Attendees are solely responsible for arranging and paying for their own travel, accommodations (unless otherwise included in their package), meals, transportation, and travel insurance. Work of Heart Photography is not responsible for travel delays, cancellations, missed flights, lost baggage, or other travel-related issues that may affect your ability to attend the Workshop.

Attendees are solely responsible for all travel arrangements and any losses associated with changes, cancellations, delays, or rescheduling.

Personal Property

Work of Heart Photography is not responsible for lost, stolen, or damaged personal belongings, including but not limited to cameras, lenses, memory cards, laptops, or other equipment brought to the Workshop. Attendees are responsible for securing their own equipment and belongings at all times.

Third-Party Financing (Affirm, Klarna, AfterpaY)

As a convenience, Work of Heart Photography may offer third-party financing options such as Affirm, Klarna, Afterpay, or similar payment providers.

By choosing to finance your purchase through one of these providers, you acknowledge and agree that your financing agreement is solely between you and the third-party financing company.

Work of Heart Photography is not a party to your financing agreement and has no authority to modify payment schedules, pause payments, forgive balances, issue credits, or negotiate the terms of your financing agreement.

Social Media & Behind-the-Scenes Content

Work of Heart Photography may capture behind-the-scenes photos or video for marketing purposes. Attendees are asked not to photograph or record during teaching or instructional moments and to respect the privacy of other attendees. Photos or videos of minor models should not be posted on social media without permission.

WORKSHOP Culture

Attendees are expected to participate with professionalism, kindness, and a collaborative spirit. The goal of the Workshop is to create an inspiring and supportive environment for creativity and connection. Work of Heart Photography reserves the right to remove any attendee whose behavior is disruptive, abusive, harassing, intoxicated, discriminatory, or otherwise interferes with the experience of other attendees. No refund will be issued.

Completion Disclaimer

While The Pivot Playbook LIVE is designed to guide attendees through building a premium workshop or retreat during the event, each attendee is responsible for making timely decisions, completing the provided exercises, and actively participating. The Company cannot guarantee completion for attendees who choose not to participate in the exercises or implementation sessions.

Assumption of Risk & Medical Responsibility

Participation in the Workshop includes activities such as travel, walking to and from shooting locations, and working in various environments.

By attending the Workshop, you acknowledge that participation involves inherent risks and you voluntarily assume full responsibility for any injury, illness, loss, or damage that may occur.

You confirm that you are physically able to participate in the Retreat and that you will take responsibility for your own health, safety, and personal belongings. Work of Heart Photography is not responsible for medical expenses, accidents, injuries, or illness that may occur during or in connection with the Retreat.

Photography & Media Release

By attending the Workshop, you acknowledge and agree that photographs, video recordings, or other media may be captured during the event by Work of Heart Photography.

You grant Skye Edmonds and Work of Heart Photography the irrevocable right to use any photographs or video footage that include your likeness for promotional, educational, marketing, or social media purposes without compensation.

If an attendee prefers not to appear in promotional media, they must notify Work of Heart Photography in writing prior to the start of the Workshop.

Payment Disputes / Chargebacks

By purchasing a seat at THE PIVOT PLAYBOOK LIVE, you agree that all sales are final and non-refundable as stated in the Refund Policy.

You further agree not to initiate a chargeback, payment dispute, or reversal with your credit card company, bank, or payment provider.

If a chargeback or payment dispute is initiated after purchasing the Workshop, you agree that this constitutes a breach of this agreement.

In the event of a payment dispute or chargeback, Work of Heart Photography reserves the right to provide these Terms of Use, proof of purchase, and evidence of participation to the payment processor or financial institution as evidence that the charge is valid and authorized.

You also agree to reimburse Work of Heart Photography for any fees, costs, or expenses incurred as a result of the chargeback or dispute, including administrative fees, collection costs, and legal expenses if applicable.

Entire Agreement

This Agreement represents the entire agreement between the parties and supersedes any prior communications or representations, whether written or verbal.

Limitation of Liability

Skye Edmonds and Work of Heart Photography shall not be liable for any damages, injuries, losses, or claims arising from participation in the Workshop.

Participants assume all risks associated with travel, photography activities, and participation in Workshop events.

In no event shall Work of Heart Photography be liable for any indirect, incidental, or consequential damages.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By purchasing and/or participating in THE PIVOT PLAYBOOK LIVE, you acknowledge that you have read, understood, and agree to these Terms of Use.
